Over his legal career, Mr. Betts has been responsible for handling, evaluating and exploring the resolution of hundreds of lawsuits and arbitrations involving a wide range of disputes – including commercial litigation, business disputes, employment discrimination, trade secrets and restrictive covenant litigation, banking litigation, claims arising from the sale of insurance products and variable annuities, securities and investment-related litigation and FINRA arbitrations. Mr. Betts is on the approved roster of mediators and ADR neutrals for the U.S. District Court for the Western District of Pennsylvania. He also has been approved by the Court to serve as an E-Discovery Special Master. Mr. Betts has nearly forty years of experience representing corporate and individual clients in a wide range of litigation matters in federal and state courts in Pennsylvania, as well in numerous arbitration cases. The types of matters Mr. Betts has successfully handled include complex commercial litigation, business disputes, securities litigation (including FINRA arbitrations), investment-related claims (including claims related to annuities and other insurance products), trade secret/non-compete litigation, banking litigation, class actions, consumer litigation, and professional negligence cases, including accountant malpractice claims. Mr. Betts was formerly a Litigation Partner with Reed Smith Shaw & McClay (now Reed Smith LLP) and his approach to litigation is to handle matters with the level of sophistication and thoroughness that large firms provide, but in the context of a small “boutique” litigation firm that provides its clients with personal attention, efficiency and responsiveness.
Mr. Betts provides a range of ADR services. In addition to having served as a mediator in numerous cases, Mr. Betts provides other ADR-related services, depending on the desires of the parties and their counsel and the circumstances involved in particular disputes. ADR services other than mediation offered by Betts Dispute Resolution include private arbitration and early neutral evaluation (ENE). In connection with the mediations he handles, Mr. Betts employs an approach that he believes will maximize settlement possibilities, but generally prefers an “evaluative” mediation approach through which he assists the parties and their counsel in objectively evaluating the strengths and weaknesses of their positions and in fully considering the legal fees and other expenses that the parties will incur if a settlement is not achieved.
